Terms of Sale

These Terms of Sale (the "Terms") apply when you buy OREUM products on this website. They are a contract between you and Dracan Market LLC, a Wyoming limited liability company ("OREUM", "we", "us" or "our"). Please read them before you order. By placing an order, you accept them.

In short: you must be 18 or older, with a delivery address in all 50 US states and Washington, D.C. Prices are in US dollars, with shipping and import duties included, and sales tax, where it applies, is calculated at payment. You can cancel at no cost until your order ships. Unopened products, and an unused massager or dock, can be returned within 30 days of delivery; for hygiene reasons, an opened bar, conditioner or oil cannot. Anything that arrives defective, damaged or wrong is replaced or refunded, even if opened. Our formulas are cosmetics, not medicines. These Terms do not require arbitration.

1. Who we are

2. Who can buy

• You must be at least 18 years old and able to enter into a binding contract to place an order. At checkout, you confirm that you are 18 or older.
• If you are under 18, you cannot order yourself. A parent or legal guardian can order in their own name; they are then the buyer, and responsible for supervising how the products are used.
• We deliver only to street addresses in all 50 US states and Washington, D.C. See Section 15 and our Shipping & Delivery policy.
• We sell to individual customers, for their own use or for their family and household, not to resell. We may limit the quantity of a product per order.
• Please give us accurate contact and delivery details. We use them to deliver your order and to reach you about it.

3. Our products

• Product information: each product page shows what is in the box, how to use the product, its key ingredients for the formulas, its details and its safety information. Please read it, and our Ingredients & Safety page, before you order.
• Cosmetics, not medicines: The Scalp Bar, The Conditioner Bar and Rosemary & Ginger Scalp Oil are cosmetics. They cleanse, condition and scent the scalp and hair. They are not medicines and are not intended to diagnose, treat, cure or prevent any disease or condition, including hair loss. If you notice sudden or patchy shedding, or have a scalp problem, please see a doctor or a board-certified dermatologist.
• The tools: the Scalp Massager and the Bamboo Bar Dock are accessories for the routine. They are not medical devices.
• Ingredients: the key ingredients of each formula are listed on its product page, and we email the complete ingredient list on request, before you order if you like.
• How a product feels: hair and scalps differ, and so do water, climate and routines. How a product feels on your hair depends on all of these, so we cannot promise a particular outcome.
• Photos: our photos and images show the products and how they are used. We show them as faithfully as we can, but colors look different from one screen to another, the color and herbal flecks of a bar vary slightly from one batch to the next, and the people, props and scenes in our images are not included.

4. Prices, sales tax and import duties

• All prices are in US dollars (USD). Each product has one price, shown on its product page.
• Shipping is included in the price; there is no separate delivery charge.
• Our prices include import duties. Import duties and customs fees are paid by us. If a carrier ever asks you for any, contact us and we will cover it in full.
• Our prices do not include sales tax. Where the law of the state you ship to requires us to collect it, sales tax is calculated at payment from your delivery address and shown as its own line before you pay.
• Where we do not collect sales tax, your purchase may still be subject to use tax in your state. Your state's tax department can tell you more.
• We may change our prices at any time. The price that applies to your order is the one shown at checkout when you place it.

5. Promotions

We do not run any promotion at this time: there are no promotional codes, no reduced prices and nothing added to orders. If we ever run a promotion, its terms (what it applies to, when it starts and ends, and any conditions) will be shown with it, and these Terms will still apply to the order.

6. Orders and order confirmation

• Online payment is not open yet. Until it opens, no order can be placed and nothing can be charged on this website. These Terms apply to every order placed once it opens.
• Before you pay, the checkout page shows each item, its quantity and price, shipping (included), the total, how sales tax is added, the accepted payment methods and when your card is charged, the estimated delivery, and how cancellations and returns work, with links to these Terms and our Privacy Policy. Please check them carefully.
• When you place an order, you ask to buy the products in it. We email you an order confirmation once your payment is authorized. Your order is accepted, and the contract between us is formed, when we send that email. If it has not arrived within a few hours, check your spam folder, then write to us.
• We may decline or cancel an order before it ships if we suspect fraud, cannot verify the payment, cannot deliver to the address given, have reason to believe the person ordering is under 18, or if a product is not available. If we do, we tell you and refund everything you paid within 5 to 10 business days.
• We send order confirmations, shipping and tracking emails, delay notices and other messages about your order by email. You agree that these emails meet any legal requirement for such communications to be in writing. We do not send marketing emails unless you sign up for them yourself.

7. Pricing and stock errors

• We work to keep our prices, descriptions and stock right. If a price on our website is clearly wrong, for example far below the real price, we may cancel the affected items before they ship, even after we confirmed the order. We tell you by email and refund everything you paid for them.
• If a product turns out to be out of stock after you order, we email you with the expected shipping date and you choose between waiting and canceling for a full refund.

8. Payment

• Accepted payment methods: Credit and debit cards (Visa, Mastercard, American Express, Discover), Apple Pay and Google Pay.
• When you are charged: your payment method is charged when you place your order, for the total shown at checkout. Every order is a one-time purchase: there is no subscription and no automatic renewal, and we never charge you again without a further order from you.
• Card security: card details are entered on the secure payment page of our payment provider, Stripe, which complies with the Payment Card Industry Data Security Standard (PCI DSS), and travel encrypted over HTTPS. We never see or store your full card number or security code.
• Your card statement: the charge appears as OREUM. If you do not recognize a charge, please email us first, before you contact your bank, and we will tell you what it is right away.
• Currency: all charges are in US dollars. If your card was issued outside the United States, your bank may add its own foreign transaction fee. We do not charge one.
• By placing an order, you confirm that you are authorized to use the payment method you provide.

9. Shipping, delivery and risk of loss

• Shipping is included in the price; there is no separate delivery charge. That stays true whatever the order contains, even if it ships in more than one package.
• We ship your order from our partner warehouse overseas within 1 to 3 business days after it is confirmed. Transit then takes 7 to 12 business days, so most orders arrive about 8 to 15 business days from order confirmation. Delivery dates are estimates. Every order is tracked.
• If we cannot ship within the time stated, we tell you before that time runs out and give you the choice to accept the delay or cancel for a full refund, as the Federal Trade Commission's Mail, Internet, or Telephone Order Merchandise Rule requires. See Shipping delays.
• Ownership of the products, and the risk of loss, pass to you when the carrier delivers your order to the address you gave us. If a package is lost or damaged before delivery, we reship or refund it.

10. Cancellations

You can cancel your order at no cost at any time until it ships. Email us at mk.beramicedracan@gmail.com with your order number and "Cancel" in the subject line. If the order has not shipped, we cancel it and refund the full amount you paid, sales tax included, within 5 to 10 business days.

Once your order has shipped, it can no longer be canceled: it becomes a return, under Section 11. See Cancellations.

11. Returns and refunds

Unopened products in their original condition, and an unused Scalp Massager or Bamboo Bar Dock, can be returned within 30 days of delivery. For hygiene reasons, an opened or used Scalp Bar, Conditioner Bar or Scalp Oil cannot be returned. A defective, damaged or wrong item is replaced or refunded, even if opened.

For a change of mind, the return postage is paid by you. When we made a mistake, or an item is defective or damaged, we pay it. Please email us before you send anything: we reply with the return address and instructions. Refunds go to your original payment method within 5 to 10 business days after we receive and check the return. Full details are in our Returns, Refunds & Cancellations policy, which is part of these Terms.

12. Defective, damaged or wrong items: our limited warranty

This limited warranty covers every product you buy from us on this website.

• What it covers: an item that arrives damaged, for example a broken bar, a cracked or leaking bottle or a split dock; an item with a defect, for example an oil nozzle that does not close, a formula whose smell, color or texture is clearly off when you first open it, or massager bristles that come loose in normal use; a missing item; and an item that is not what you ordered.
• How long: please tell us within 7 days of delivery about damage in transit, a missing item or a wrong item, and within 30 days of delivery about a defect. This warranty covers you even if you have opened or used the item: the hygiene rule for change-of-mind returns does not apply to it.
• What we do: we send a replacement, subject to availability, or refund the item in full, as you prefer. Photos are usually enough. If we need the item back, we pay for the return postage.
• What it does not cover: normal wear; a bar that turns soft because it was left standing in water; damage that happens after delivery, for example from a drop; use against the instructions; and personal preference, such as a scent or a feel you do not enjoy.
• How to claim: email mk.beramicedracan@gmail.com with your order number, a short description of the problem, and photos of the item, the packaging and the shipping label. We reply within 2 business days. The warrantor is Dracan Market LLC, 30 N Gould St Ste R, Sheridan, WY 82801, United States.

This warranty gives you specific legal rights, and you may also have other rights which vary from state to state. It adds to the implied warranties described in Section 13 and does not shorten them. If you notice a problem after these periods, please write to us anyway.

13. Implied warranties

Every product you buy from us comes with the implied warranties that the law of your state gives you and that cannot be excluded, such as the implied warranty of merchantability (that a product is fit for the ordinary purpose for which it is used). We do not disclaim them and we do not shorten how long they last. Nothing in these Terms takes away any warranty right that the law gives you.

Separately from the products you buy, the website itself and its general content are provided "as is", to the extent the law allows. We work to keep it accurate and available, and we correct errors when we find them.

14. Using our products safely

Please follow the instructions on each pack and product page, and our Ingredients & Safety page. In particular:

• our formulas are for external use only: keep them away from your eyes, and if they get in, rinse well with water;
• if your skin reacts easily, do a patch test first;
• if redness, discomfort or any reaction appears, stop using the product;
• The Scalp Bar and the Scalp Oil contain essential oils: if you are pregnant, nursing or under medical care, ask your doctor first;
• keep the products out of reach of children, and do not use them on broken or irritated skin;
• a wet bar is slippery, so take care in the shower.

If a product does not agree with your skin, stop using it and write to us. We look at every case and keep a record of reactions. If a reaction is serious, get medical care first.

15. Where we sell

This website sells only for delivery in all 50 US states and Washington, D.C. For now, we do not ship to P.O. boxes, to APO, FPO or DPO military addresses, to US territories, or to any address outside the United States, and we do not knowingly sell to anyone who plans to export the products. If you take a product out of the United States, you are responsible for following the rules of the country you bring it to.

16. Limitation of liability

Nothing in these Terms limits or excludes our liability where the law does not allow it, such as liability for personal injury or property damage caused by a defective product, or for our gross negligence, fraud or willful misconduct. Nothing in them takes away your rights under the consumer protection and implied warranty laws of your state either.

Subject to that, and only to the extent permitted by law:

• we are not liable for indirect, incidental, special or consequential damages arising out of or relating to these Terms, the website or the products you buy from us; and
• our total liability for any claim relating to an order will not exceed the amount you paid for that order.

Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you. If you live in New Jersey, the limitations and exclusions in this section do not apply to claims under the New Jersey Consumer Fraud Act or the Truth-in-Consumer Contract, Warranty and Notice Act, or to the extent New Jersey law forbids them.

17. Governing law and where claims are heard

These Terms, and any dispute about them or about an order, are governed by the laws of the State of Wyoming, without regard to its conflict of law rules. This choice of law does not deprive you of the protection of any law of your state of residence that cannot be waived by agreement.

If a dispute is not settled informally under Section 18, either of us may bring it in small claims court, or in the state or federal courts located in Wyoming. This does not take away any right the law of your state gives you to bring a claim in the courts where you live.

18. Resolving a problem

Most problems are settled quickly by email. If something has gone wrong, write to us at mk.beramicedracan@gmail.com with your order number, what happened and what you would like us to do. We reply within 2 business days.

• Informal resolution first: before either of us starts a court case about these Terms or an order, the one who has the dispute sends the other a short written description of it: you to our email address, we to the email address used for your order. We then both try in good faith to settle it within 30 days after it is received. Any time limit for bringing the claim is paused during those 30 days, to the extent the law allows. Small claims court is open to you at any time.
• Card disputes and chargebacks: if a charge looks wrong, or an order has not arrived, please contact us first. We answer within 2 business days, and a refund from us usually reaches you faster than a card dispute. Nothing in these Terms limits your right to dispute a charge with your card issuer. If a dispute is opened, we send the payment provider and your card issuer the order details, the delivery tracking and the emails we exchanged, so they can decide it.
• Government agencies: nothing in this section stops you from contacting a government agency at any time, such as your state Attorney General or the Federal Trade Commission.
• No arbitration: these Terms do not require arbitration, and they do not take away your right to go to court or to join a class action.

19. Notice for California users

Under California Civil Code Section 1789.3, California users of this website are entitled to the following consumer rights notice. This website is provided by Dracan Market LLC, 30 N Gould St Ste R, Sheridan, WY 82801, United States, email mk.beramicedracan@gmail.com. There is no charge for using the website itself. The prices of our products are shown on the website and at checkout, with shipping included. To resolve a complaint about the website or an order, please contact us by email first. You may also contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.

20. Our website and its content

• You may use this website for your personal, non-commercial use. Please do not misuse it: for example, do not copy or scrape its content in bulk, interfere with its operation or security, upload malicious code, place fraudulent orders or use it for any unlawful purpose.
• The OREUM name and logo, the website design, and its text, photos and graphics belong to Dracan Market LLC or its licensors and are protected by intellectual property laws. You may view and print pages for your personal use. Buying a product does not give you any right to use the OREUM name or logo.
• Links to other websites are provided for convenience. We are not responsible for their content or practices.
• How we handle personal information is explained in our Privacy Policy and Cookie Policy.

21. Changes to these Terms

We may update these Terms from time to time. We will post the updated version on this page and change its "last updated" date. The version posted when you place an order applies to that order.

22. General

• Entire agreement: these Terms, together with our Shipping & Delivery, Returns, Refunds & Cancellations, Ingredients & Safety, Privacy and Cookie policies, are the entire agreement between you and us about your purchases on this website.
• Events beyond our control: we are not responsible for delays or failures caused by events beyond our reasonable control, such as storms, floods, fires, carrier disruptions or customs delays. Even then, we tell you about any shipping delay and give you the choice to cancel for a full refund.
• Severability: if any part of these Terms is found unenforceable, the rest remains in effect.
• No waiver: if we do not enforce a provision right away, we can still enforce it later.
• Transfer: we may transfer our rights and obligations under these Terms to a company that takes over our business, and your rights will not be reduced. You may not transfer your rights without our written consent.
• Headings: headings are for convenience only.
